Disclaimer

The content and services described on this website and through any associated communications, materials, or proposals are provided by Means.wtf, a professional freelance Android game developer. All services are offered on a contractual, project-based basis and are subject to the terms outlined below.

By engaging with our services, you agree to the following disclaimers and conditions:

1. Nature of Services

Means.wtf provides professional game development services, primarily focused on Android platforms, and utilizes various game engines and tools such as Unity, Unreal Engine, GameMaker, and others. Services may include—but are not limited to—game design, development, UI/UX implementation, prototyping, AR/VR features, blockchain/NFT integration, and platform-specific optimization.

All development is provided under a freelance/independent contractor model, and is not representative of a formal company or registered studio unless otherwise stated.

2. No Guarantees or Warranties

While every effort is made to deliver high-quality, well-performing, and fully functional games, the developer makes no guarantee regarding:

  • Market performance or financial success of any completed game
  • Platform (e.g., Google Play Store) approval or ranking
  • Number of downloads, installs, or in-app purchases
  • Bug-free or error-free final products
  • Compatibility across all devices and OS versions
  • Ongoing support for third-party tools, SDKs, APIs, or plugins

All games are developed according to the client’s approved specifications. The final result and success of a game depend on many external factors (including marketing, user behavior, platform policy changes, hardware variations, and competition), which are outside of our control.

3. Future Development and Business Intentions

While Means.wtf currently operates as a solo development service focused on Android games, the business is in active evolution and may change in scope over time. Future intentions include:

  • Expanding into cross-platform game development, including iOS, PC, Web, and Console platforms.
  • Deepening capabilities in AR (Augmented Reality) and VR (Virtual Reality) to build more immersive gaming experiences.
  • Further development in blockchain and NFT gaming, including the integration of smart contracts, token economies, and digital asset ownership.
  • Building and launching original in-house games as part of a long-term plan to create and publish self-owned IP.
  • Collaborating with other developers, artists, or studios as the business scales and transitions from solo development to a remote team or micro-studio model.

These future goals do not alter current contractual relationships but may influence the types of services offered in the future.

4. Intellectual Property (IP) Rights

Ownership of intellectual property is governed by the signed agreement between the developer and the client. Unless otherwise specified:

  • All rights to code, assets, and game materials remain the property of Means.wtf until full project payment is received.
  • Once full payment is made, IP rights are transferred to the client based on agreed-upon terms (excluding third-party licensed assets or tools).
  • The developer reserves the right to showcase completed work in a personal portfolio or for promotional use unless a non-disclosure agreement (NDA) is signed.

5. Third-Party Tools, SDKs & Services

Many game features may rely on third-party tools or services (e.g., Unity Asset Store packages, ad networks, analytics tools, in-app purchase plugins, cloud storage, APIs, etc.). While these are carefully selected and integrated, the developer:

  • Cannot guarantee long-term support or continued functionality of third-party services
  • Is not responsible for any fees, updates, changes in licensing, or discontinuation of these tools
  • Will inform clients of any dependencies during the development process

Clients are encouraged to keep third-party service credentials and licenses secure and up to date.

6. Client Responsibilities

To ensure a smooth and efficient development process, the client is expected to:

  • Provide clear project requirements and respond to feedback and questions in a timely manner
  • Supply any required assets (logos, music, IP-related materials) or indicate if they should be created from scratch
  • Review and approve milestones before progression
  • Understand that delays in communication or feedback may impact timelines

Any additional features requested after project scope approval may require separate billing or an updated timeline.

7. Payment Terms

Payment terms will be outlined in a written agreement or proposal. Common structures include:

  • Milestone-based payments for larger projects
  • 50/50 split (half upfront, half on delivery) for smaller projects
  • Hourly billing for ongoing support or updates

All payments must be made in full before final project delivery, including source code, assets, and documentation. Late or incomplete payments may result in withheld deliverables or paused development.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Means.wtf is not liable for any indirect, incidental, special, or consequential damages arising out of or related to the use, misuse, or inability to use any product or service delivered.
  • This includes (but is not limited to): data loss, business interruption, reputational damage, or lost revenue from game performance.

Clients assume full responsibility for maintaining, publishing, and promoting their games once delivered.

9. Changes to Disclaimer

This disclaimer may be updated or modified at any time without prior notice, particularly as services, legal requirements, or technologies change. Clients are encouraged to review the most recent version on the website or request a current copy when entering a new agreement.
